Terms & Conditions of Use

The purchase of any travel services offered by Urban Rhythms Tours Adventures & Travel Sdn Bhd (hereinafter referred to as “Urban Rhythms”) constitutes a contractual arrangement between you and Urban Rhythms and represents your acceptance of Urban Rhythm’s Terms & Conditions set out herein. Please ensure that you read carefully and understand these Terms & Conditions prior to booking. You are advised to check on this page or to request the latest version of the Terms and conditions of your tour contract from our travel consultant.

1. USE OF WEBSITE

1.1 This website is intended to provide users with information about our services and to facilitate the purchase of travel and lifestyle packages. No unlawful or unauthorised activities shall be conducted in this website, including but not limited to:

1. using fraudulent information or documents for bookings on or through this website;
2. activities that interfere with the operation of the site; and
3. any attempt to access or extract other user’s data.

2. BOOKINGS & PAYMENTS

2.1 All travel packages offered are subject to availability and may be updated from time to time. All prices are stated in Ringgit Malaysia and may be subject to change without prior notice.

2.2 Payment for bookings must be made in full through our designated payment gateway Curlec at the time of purchase. Payments shall be subject to the Terms and Conditions of such payment gateway as in effect from time to time and use of the payment gateway shall be deemed acceptance of such Terms and Conditions.

3. REFUNDS & CANCELLATIONS

3.1 All cancellations and refund requests must be submitted to us in writing via email. Requests will be processed in accordance with these Terms and Conditions. The effective date of cancellation will be the date we receive your written notification.

3.2 All applications for cancellation or refunds are subject to the specific refund policies applicable to any particular package and the decision to allow cancellation or refunds shall be at our sole discretion based on such policies and these terms and conditions.

3.3 Refunds will not be granted under the following circumstances:

1. for cancellation made less than 7 days before the scheduled start of the tour
2. for any unused service once the tour has commenced;
3. if you fail to attend and/or arrive late for the scheduled tour; and
4. any reason specifically identified in any separate refund policies applicable to any particular package

3.4 If you choose to rebook a different programme/destination, you will be required to pay any price differences or surcharges applicable to the new programme.

3.5 Failure to make full payment during the booking process may result in the booking being void and the slot being released without notice.

4. INSURANCE

4.1 All travellers are strongly encouraged to obtain, at your own cost, a comprehensive travel insurance policy to protect against unforeseen circumstances, such as baggage loss, flight delays, travel agent insolvency, medical emergencies and etc. Urban Rhythms shall not be responsible, under any circumstances, for any such matters.

5. TRAVEL DOCUMENTS

5.1 Each traveller is solely responsible for ensuring their passport or travel documents are valid for at least six (6) months from the date of departure and that they have obtained the necessary visas, permits, passes and other approvals required by the destination country.

5.2 Urban Rhythms shall not be liable for any loss, expense or refund if a traveller is refused entry or deported due to incomplete documents, immigration issues and/or any other reason outside the control of Urban Rhythms.

5.3 Each traveller is also required to ensure that the name provided during booking matches with their passport or travel document. Any correction or amendment will be at the traveller’s own cost.

6. THIRD PARTY SERVICES

6.1 While using this website, you may encounter banners, links and/or pop-up advertisements that lead to third party websites and/or promotions. These links and advertisements are not affiliated with Urban Rhythms. In no event shall Urban Rhythms be held liable for any losses, damages, fraud and/or consequences resulting from your interaction with such third-party banners, links and/or pop-up advertisements.

6.2 Urban Rhythms has no control over the content, accuracy and/or security of any third-party websites or promotions, and we do not endorse, sponsor and/or guarantee any of the products, services and/or offers featured on them. You are advised to access these third-party websites entirely at your own risk.

6.3 Some travel services may be provided by independent third-party vendors (e.g. hotels, transport operators). Urban Rhythms shall not be responsible for any acts, omissions, or service failures by these third parties. Your use of their services shall be subject to their Terms and Conditions.

7. INTELLECTUAL PROPERTY

7.1 All content on this website, including text, images, graphics, logos, and videos, is the property of Urban Rhythms. You may not reproduce, distribute, or modify any content without prior written consent.

8. INDEMNIFICATION

8.1 By continuing to use this website, you agree to indemnify, defend and hold harmless Urban Rhythms, including its officers, directors, employees, agents, licensors and service providers from and against all claims, losses, liabilities, damages, costs and expenses arising from your breach of these Terms, misuse of the website, or any unlawful or negligent actions by you or anyone using your account.

9. PERSONAL DATA PROTECTION

9.1 Urban Rhythms is committed to protecting your personal data in accordance with applicable data protection laws and regulations. All personal data is treated with strict confidentiality to safeguard all information processed including your personal details, order information and transaction data.

9.2 Urban Rhythms may for the purposes of enhancing the products and services it has available or improving the customer experience disclose, provide, make available or permit access of your personal or confidential data to its service providers. By use of this website, you hereby grant specific consent to Urban Rhythms to use, process, and/or retain such data for such purpose.

10. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

10.1 All feedback, suggestions, ideas and other contents submitted to Urban Rhythms through this website shall become the property of Urban Rhythms. By submitting these, you confirm that your submissions do not violate any third-party rights and do not contain offensive, abusive and/or defamatory material. 11.1 These Terms shall be governed by and construed in all aspects in accordance with the laws of Malaysia, without giving effect to conflicts of law principles.
